Terms of service
Who you are dealing with
ApexDatum is owned and operated by fyv.ai Ltd. These terms are an agreement between you and fyv.ai Ltd., and “we” means that company everywhere below.
What this is
ApexDatum publishes statistical projections and modelled probabilities about American football. It is a data product. Every number is an estimate produced by a model from public inputs, and every forecast ships with its uncertainty range because a point estimate without one is not a finding.
What this is not
We do not publish picks, stakes, expected-value numbers, arbitrage alerts or wagering recommendations, at any price, on any plan. This is a deliberate commercial decision rather than an oversight: it is the most expensive verified category in the market and we are choosing not to enter it. Where our model and a betting market disagree, our stated prior is that the market is more often right.
Nothing here is financial, investment or betting advice. If you use these numbers to decide anything with money attached, that decision is yours.
Accounts
Sign-in is by one-time email link; we store no password. You are responsible for access to your email account and for API keys you create. A key is shown once and stored only as a keyed hash - we cannot recover it for you, and you can revoke it at any time from your account page, which takes effect on the next request.
Plans, seats and use
Scout, Active, Feed are the plans. Seats mean people: 3 on Feed, one on the others. Use within your organisation is included at every paid plan.
Republishing is not. Putting our numbers in front of someone who is not you - in a product, a newsletter, a public dashboard or a resold feed - requires the Commercial Redistribution Licence, which is a separate agreement and is not self-serve. Licensees are bound by the same rule we are: our divergence numbers may not be presented as picks, expected value, or wagering recommendations.
One-off passes
2026 Draft Kit and 2026 In-Season Pass and 2026-27 NHL Season Pass are dated, one-time purchases. They grant a plan until a stated instant and then stop. Nothing renews, no card is kept on file, and the expiry date shown at the time of purchase is the one you keep even if we later correct the published date.
They are non-refundable. Access begins when the payment clears, and you are told this on the payment screen before you pay as well as here. Two exceptions survive it, and neither needs arguing for: if the access you paid for does not arrive or does not work we refund in full, and nothing here removes a right you hold under the consumer protection law where you live. Refunds and cancellation sets both out.
Availability and change
The dataset carries a version and a build timestamp, and both are public at /api/v1/manifest. Several packages are built from a fixed set of source artefacts and do not currently regenerate; where that is true, the package says so on its own page rather than in this document. We may change methodology, and when a published number changes materially we would rather publish the correction than quietly restate it.
Liability
The service is provided as is. To the extent the law allows, our total liability is limited to what you paid us in the preceding twelve months. We do not warrant that any projection will be accurate - the entire Verification Ledger exists because some of them are not, and we publish the ones that failed.
Ending it
Cancel any time; access continues to the end of the period you have paid for. We may suspend an account that redistributes without a licence, that attempts to evade quotas, or that presents our numbers as wagering advice.
